If You Still Have an Unclaimed Cleverbuy Voucher, Read This!

I am pissed off right now. If you have an unclaimed voucher from Cleverbuy or CleverTravel, then you should be too. Why?

Cleverbuy is now closed!

I received a comment at my previous Cleverbuy post last May 18, detailing the company's very poor customer service. I got worried because I also have an unclaimed travel voucher that I bought from Cleverbuy, but I didn't panic since I had encountered problems with vouchers bought from other sites before (so I was sort of a veteran) and I was planning to use my voucher at the latter half of this year (I thought the problem would go away once the busy summer season ended).

A few days afterwards, I got links from Promoblogger and Everything in Budget and learned that after lying to several customers about booking their flights and accommodations, J2 Discount Travel and Tours had shut down and that Cleverbuy would be handling the refunds for the botched travel deals. J2 Travel and Cleverbuy occupied the same building and many people believed that they were sister companies.

Cleverbuy apparently issued an official statement and denied any ties with J2, but that link (as well as the whole Cleverbuy blogspot blog) has been deleted. I hope someone was able to screen capture that statement. It might prove valuable in court.

Customers who went to Cleverbuy's office had to fill up a refund form and wait for 3-4 weeks. Some of these customers wouldn't settle for the 3-4 weeks waiting period and demanded to have their money back at once. They got post-dated checks.

Someone claiming to be a DTI representative gave his email address (dtincrlegal@yahoo.com) so that complainants could contact DTI but I don't know how many responded to that offer since the email address didn't look official. It would have been better if the email address was @dti.gov.ph instead of @yahoo.com.

On May 29, Cleverbuy stopped issuing checks and only gave out promissory notes (to be paid on or before June 30). Several employees have already resigned and an NBI officer also arrived to serve a subpoena to Edgardo Garcia. A preliminary hearing against Cleverbuy will be held at the NBI headquarters this Friday, June 1 at 2:00pm. Complainants can attend this hearing.

What the hell happened?
It's still unclear what exactly happened. Some customers posted that merchants (travel and non-travel) denied their vouchers because Cleverbuy has not paid those merchants yet. Someone also said that according to Cleverbuy, Triptoe Travel scammed Cleverbuy and took off with their money.

According to some posts in Cleverbuy's Facebook page, some complainants last Monday got so angry that they took some items belonging to Cleverbuy, so there's a grain of truth in Cleverbuy's claim of harassment.

But, and a very big but if I may say, four things about this whole mess jump out at me.
  1. If Cleverbuy was not out to scam people, the least that the company could have done at the beginning was to inform every affected buyer that his deal was cancelled and that he would get a refund, then to issue a definite schedule for the release of the funds. Deals get cancelled due to merchant problems but being transparent would have prevented people from panicking like this. Why did the customers have to hear the bad news from other people anyway? Geez.
  2. If Cleverbuy was not out to scam people, they would face their customers. Sadly, I keep hearing that calls, emails, and Facebook page posts remain unanswered. Worse, even those who went to their office were treated coldly/rudely. They had to go back several times and the staff did not appear apologetic or even sympathetic. Even if they give out refunds, Cleverbuy has wasted a lot of people's time and caused a lot of disappointments. And now, surprise surprise, Cleverbuy is now temporarily closed. If security was really their reason, they could have just asked policemen or guards to be around to prevent violence or petty crimes as they processed the refunds.
  3. Cleverbuy has deleted their blog and stopped updating their Facebook page. Instead of issuing statements that could easily reach their customers, they just disappeared. Is Cleverbuy afraid of having their own written words used against them in court? What's next, deleting the FB page and the Cleverbuy site itself?
  4. Cleverbuy has stopped issuing post-dated checks as per their lawyer's advice. Hmm, why? The sooner people are paid off, the sooner they'll get off your back, right? So why? Is it because funds are dwindling and Cleverbuy is afraid that checks will bounce and they will get hit with (more) lawsuits since bouncing checks = estafa? I certainly hope not. I hope you have the funds to give everyone a refund.

Updates as of May 31, 2012 evening
The cellphone numbers Cleverbuy gave became inactive. An NBI hearing is set at the Anti-fraud Department (5th floor) of NBI Taft. Conflicting reports if the hearing will be complainants vs Cleverbuy and Triptoe OR Cleverbuy vs Triptoe.

I got in touch with Dolly, another victim who wants a refund. She's out P135K. Ouch!

I considered sending a message through FB to the treasurer/GM/whatever Edgardo Garcia but he does not seem to be an active Facebook user so I did not bother.

I got info about Cleverbuy's foreigner (German?) owner, but I don't know which one is correct.

The DTI email address dtincrlegal@yahoo.com seems to be legit but don't expect a sympathetic reply. You can also call DTI at 8118231 or visit the DTI NCR Web site. Better if you can drop by the DTI office. Complainants are asked to file a formal complaint detailing the transaction and attach all evidence or proofs of transaction.

If your trip has already been scheduled, better check again. A buyer got a cancellation letter from a previously booked resort. Apparently, the resort owner is also preparing a demand letter against J2 Travel and Cleverbuy for P500K that has not been remitted to them.

There are already at least 5 formal complaints filed against Cleverbuy. Another meeting is set at NBI on June 8, also at the Anti-Fraud Division at 2pm. Do not wear shorts and/or slippers, because you might not be allowed entry.

According to Dolly, who went to the hearing earlier, there is still a chance to get a refund but that chance is getting slim. They signed a complaint letter as a group but they still have to submit individual notarized affidavits. If you want to join, get your affidavit and voucher copies ready and submit them next week at the Anti-Fraud Division (Room 503) or Computer Crime Unit (Room 508). Keep in mind, however, that there's no backing out after you've filed your complaint. Getting a refund is not assured, what they're really going for is to have a case against Cleverbuy.

A commenter in another site suggested that complainants should bring demand letters and have Mr. Garcia sign them instead of requesting for promissory notes because promissory notes can lessen the impact of the case from criminal to civil, unlike demand letters. If you're going to the meeting on June 8, bring your voucher(s), a sworn statement/personal affidavit, and a demand letter.

I've confirmed that there is/was someone in Cleverbuy named David Staudigel (General Manager). I've downloaded videos uploaded by Cleverbuy and will analyze and reupload them on my Youtube account so that those videos will still be available even if Cleverbuy decides to take them down.


Updates as of June 4, 2012 3pm
According to its DTI registration, TripToe Travel is based in Iligan, Lanao del Norte and is owned by Amielyn Madale Limbona who is also the owner and manager of Cashmere Travel and Tours (also in Iligan). Limbona was charged with estafa by Sarrosa International Hotel and Residential Suites in Cebu last January 2011 after Cashmere failed to pay the hotel P187,794 despite the hotel's repeated demands.

Last June 2, ABS-CBN News reported about Cleverbuy.

I was also able to talk to a former Cleverbuy employee who resigned a few months ago. Things I learned from our conversation:

  • Edgardo Garcia is a dummy used by Cleverbuy's owner Christian Bayer. Cleverbuy's mother company is Webix Business Solutions Inc., a Web developer which caters mostly to European clients - building dating sites, porn sites etc (those are legal in Europe so no issue there). Garcia used to be an ordinary employee but he was promoted to General Manager when the previous one resigned. The promotion was possibly a show of gratitude since Garcia helped Bayer get out of jail when a disgruntled employee fired from the company reported Bayer to the NBI and Bayer spent a day under NBI custody.
  • David Staudigel is Czech Republic's Country Manager. He is not the owner of Cleverbuy but he represents Bayer if the latter is not here.
  • J2 and Cleverbuy are indeed sister companies. The problem started when the previous country manager (Chris Arañez) accepted all the deals offered by Trip Toe and gave Trip Toe an advanced payment. The money that was supposed to be used by J2 in dealing with the different resorts was used for TripToe instead.
  • My contact suspects that someone inside Cleverbuy embezzled some funds aside from TripToe running off with the money they got.
  • Salaries of employees were usually delayed and these employees have not received their wages last May.
  • Christian Bayer is in Germany now but if David Staudigel will get a hold departure order, Bayer will most likely go back here.
  • When asked if Bayer can afford to settle all the refunds, my contact said "Yes". As it turns out, Christian Bayer owns two Lamborghini cars. Dating and porn sites are also profitable.

Updates as of June 5, 2012 7pm
Cleverbuy's bank account is already closed. But please do not rip up the check you got from Cleverbuy out of frustration. It's evidence. Make copies of it and as one bank suggested, to be able to use the check in filing a case, deposit the check in a bank account and get a documentation that the issuing bank account was already closed.

DTI still accepts complaints related to Cleverbuy but is now encouraging complainants to complain directly to NBI. See the info in previous updates above to know how to go about complaining to NBI.

Since I paid via Paypal, I thought of filing a case in Paypal but Paypal only has protection up to 45 days (I bought my voucher last January). If you paid via Paypal and your transaction is less than 45 days old, try that avenue.

If you just bought your vouchers recently and via credit card, call/email your bank and ask if you can reverse the charges. Explain your side thoroughly. As far as I know, one of the advantages of using a credit card is that the bank can intercede between the buyer and the merchant if a problem arises. Customers can also submit refund requests to Mozcom. According to Mozcom, Cleverbuy still gets in touch with them.

According to Fully Rich Man, another travel agency that advertised with Cleverbuy (and also one of the unpaid merchants), Cleverbuy had a meeting with the merchants yesterday. The following Cleverbuy officers were present and could be contacted using the numbers on the right:

  • Tere Camba - 09487118714 (acting accounting manager)

According to FullyRichMan, Mr. Garcia looked unfazed even when told that there were charges filed against them. Mark Telan already has a resignation letter that will effect on June 15.

According to one commenter (Ida), her lawyer asked her for the case# of other complainants who already filed thru NBI or DTI. The lawyer will include it in Ida's complaint affidavit so that it will be a case of Syndicated Estafa. At least 5 names and their case # are needed. To those going to the meeting tomorrow, please discuss this with the other complainants. You can also email me your name and complaint number at admin@unsugarcoatedreviews.com so that I can forward the info to others who need them.

Can anyone from Davao confirm this and if the office is still open? "They [Cleverbuy] also have an office at Davao which can be found at Unit 9 2nd Level EBL Building, 26 Inigo Street, Barangay Obrero, Davao City."

If you live in far places or don't have the time to go to NBI, I think you can just send your notarized affidavit and other papers via courier. I don't know this for sure, though, so better check with NBI first.

Cleverbuy's CEO Christian Bayer was spotted at Greenbelt by ex-employees who are helping the complainants. When asked about his plans, he denied that he is the owner of Cleverbuy. Oh boy oh boy!

Trip Toe apparently has resurfaced. Interesting. A buyer who availed deals from Trip Toe via Cleverbuy was able to converse with Trip Toe via email. The conversation though was very roundabout and the refund issue was being sidestepped. Guess what, Trip Toe is blaming Cleverbuy - saying that Cleverbuy has not forwarded payment to them. Instead of a refund, Trip Toe was insisting on offering rescheduled tours.

    1. and from my source that all employees from managers to rank and file did not give any salaries up to now, that is why they are closed who is going to work for nothing, and even put their lives in to danger. And it was only happend this May when J2 discount travel and tours cancelled all the flights. . .

    2. I got a voucher from them but only tickets were issued. I was able to travel to puerto prinsesa but I shouldered the accommodation fees. Mr. Garcia promised and I got a hand written letter dated May28 that they will reimburse the cost. I just came back from puerto prinsesa and saw the news on tv that the office is now closed. I think i wont get any reimbursement :-(

    1. You're right Koko, but the thing with Cleverbuy is they were legitimate before. Buyers were able to buy and claim their vouchers until the early part of this year (even the travel deals). And suddenly, kaput!

      we also received a confirmation that we would be receiving our refunds. The email was dated on April 23,2012 and we were told that the we would get it within 30-45days. I sure do hope that we would be able to get the refunds. My friends and I are also too busy to go to NBI and file a complaint. Do we have any other options in dealing with this? Can we not email someone to take care of all the complaints?

    1. We're on the same boat April. It has gotten more complicated now that the Cleverbuy office has closed. As far as I know, there is still no definite feedback from NBI and DTI about Cleverbuy. I tried calling their numbers a few minutes ago, all dead. I'll try again tomorrow during office hours.

      Some people seem to have gotten a prompt response when they emailed dtincrlegal@yahoo.com for their complaints. It will probably help if you send your voucher as attachment in your email.

      You can also go to the NBI hearing tomorrow, 2pm. According to a post I saw online a while ago, the hearing tomorrow will be at the Anti-fraud Department (5th floor) of NBI Taft. It's unclear if the hearing will be complainants vs Cleverbuy and Triptoe OR Cleverbuy vs Triptoe.

    Hi guys, sorry quick updates lang po ito, pauwi pa kasi ako ng Tuguegarao and I just got home from NBI. Unfortunately, to sum it all up, parang malabo na makapag-refund pa tayo. May hope pero don’t keep it high, for those who wants cleverbuy to pay for what they did whether monetary or not, then ya’ll have to decide if you want to come with us and submit your affidavits. We signed a complaint letter as a group but we still have to submit each one’s affidavit where you state your own story then have it notarize then submit it anytime next week at the anti-fraud division, room 503. Look for Atty. Minnie Retanal or Ms. Evelyn. Please keep in touch, mas madaming complaints mas maganda. Pero bawal po umatras once ma-file na yung kaso as per Atty. Retanal’s request, kasi they don’t want to waste time on people who’s aim is to get their money lang, kasi wala daw assurance yun, ang ilalaban na lang talaga dito is makasuhan si Cleverbuy. Kaya weigh nyo na rin muna ang situation, no pressure.

    1. Bring your notarized affidavit to NBI. Include the details of your transaction (if you're a small group I guess you can put the names of the different Cleverbuy account holders and credit card accounts used in just one affidavit).

  13. I guess the moral of the story is not to easily fall for deals from groupon sites. I used to be addicted to buying vouchers, but I have stopped after realizing that I wasn't really getting a good deal after all. If you compare the so-called "discounted" price the groupon site offers with the actual price from the establishment, it often turns out to be a wiser decision to go with the original price.

    2. We to J2 last May 19, sabi doon magopen daw sila ulit ng May 21. Were they telling the truth? Hindi na kami ulit bumalik sa J2, we went straight to Cleverbuy on May 22. Got our check the next day. Anyway, their CSR told us Cleverbuy wants to "takeover" J2 daw dahil sa maraming issues ni J2. I don't know if this is true, considering rumors that they're one and the same, or at least sister company.

    1. You have a point. Have you talked to Holy King and told them that you're planning to sue them? If not, try talking to them first. Who knows, they might agree to honor your vouchers or refund your money. You'll be saving yourselves the time and legal expenses.

      Although as a side note, I've talked with people from Dermaesthetique. Talagang hindi nagremit ng payment ang Cleverbuy (for the month of May), and the owner of Dermaesthetique is suing Cleverbuy on her own. She lost a month's worth of income for all her 7 branches. Naawa rin ako sa merchant kasi scammed rin siya.

Checked their site, they're selling promos again, including a whopping 300k promo for some franchise. I don't know if they're out to scam more people to fund the PDCs they've already issued.   22. We went to Cleverbuy building last Friday and our group (complainants) while having lunch at KFC near Buendia, we luckily saw news anchor Henry Omaga-Diaz. We asked for help and he helpfully referred us to Maan Macapagal of ABS-CBN news reporter. And thanks to both of them they referred us to Investigation Agent VI Migdonio Congzon. And they want us to provide a formal complaint affidavit that is notarized and to be submitted ASAP. Our group of complainants are scheduled to meet up tomorrow between 9AM-10AM (June 4, 2012) @NBI. To those who want to participate please don't wear shorts and slippers. BRING YOUR COMPLAINT AFFIDAVIT (NOTARIZED) and attach the copies of vouchers you have purchased.

    Anyone here where can we have our demand letter signed? I don't know where to reach Mr. Garcia. Thank you very much.

Nagpost ba sila ng deals para umiwas sa duda ng mga taong di pa nakakaalam? may unclaimed voucher din ako pero worth 200 php lng kya di maxado masakit.

May time na binibuild-up niya si Mr. Garcia at may anggulo siya na dinidiscourage niya na magfile ng complaint yun mga victims. Na kesyo dapat committed, na once mafinalize yun complaint wala nang atrasan. Which, siyempre kung may trabaho ka mapapaisip ka.

    2. Interesting (in a negative way). I think one of those who sent DTI an email before got the reply "Mediate don't litigate."

      On the other hand, there are some people who complain and express outrage but don't see things through. I hope DTI is just discouraging that kind of behavior and is not involved in any kind of conspiracy.

    4. Guys, let's not be abrupt in our assumptions. Ako rin kasi, I made a point to Atty. Retanal na kung tutuusin I just want my money back (135k). Kaso sabi nya, hindi nga pwede yung ganun lang. Hindi naman sila collection agency, andun daw sila to have a case filed to mr. garcia/cleverbuy. I was there on June 1, sino ka ba dun ma'am or sir? Lahat naman kami nag-uusap dun a, kung in doubt ka bakit di mo sinabi kagad sa min para tinulungan ka din namin maghimay ng kuro kuro mo. Isa pa, I spoke with our family friend who happened to be the director of customs and our family lawyer. I was endorsed to his friend sa division na yun. Kung nakita mo or isa ka sa mga nahuling umuwi, kinausap nya si Atty. Retanal to expedite our complaints. Oh well, I understand you, ang hirap na kasi magtiwala pero mas mahirap kung lahat na lang ng makakusap natin e puro tayo doubt. Siguro kung ganyan tayo mas mabuti na lang na wag na lang tayo kumibo at i-charge na lang sa experience yang nawalang pera nyo. Just my two cents though!

Well, wala naman magagawa kung magtatalo pa kami ng gf ko, siya nag purchase non sinabi na lang niya agad sakin na mag deposit na ako. Ako naman nag deposit tsk.

    1. Hi Grace. Bring a notarized affidavit detailing your story and transaction info. I'm not that familiar with legal papers but afaik a lawyer will be the one to write the affidavit after you tell him your story. Specify the terms of the deals you bought, how many vouchers, how you paid, attempts you made to redeem them (if any) etc etc. Basically, detail everything.

      Someone also suggested bringing a demand letter and have Edgardo Garcia sign it.

      Check back here regularly, I post updates whenever I find more info.

  32. I was wondering, does it mean all unredeemed vouchers issued by cleverbuy are affected? Cause i have an unredeemed voucher for Yoshinoya and asked my dad to redeem it last June 1, he told me Yoshinoya told him it was on hold and to call Yoshinoyas hotline number, when i tried to call the number it was unattended or out of coverage area.

    I feel really bad for those who lost hundred of thousand due to this incident.

    2. Ah, its really unfortunate. I thought it only affected the Triptoe Travel buyers and not the rest of cleverbuy products. I was wondering if the other merchants would take advantage of this. Like if they would be telling they were not payed but in reality they were payed before this incident occurred.

      Well, i wished all the best for the complainants that they get back their money. I won't file my complaint since my vouchers is less than the charges of the complaint.

  33. I know Cleverbuy and they are not a scam. The company invested lots of money for this business with high hopes and belief that it will prosper. It is unfortunate that things turned out this way. I'm not in the position to speak for the company, but I can assure you that this is NOT a scam and the company never intended to just run away with your money. It is just my OWN opinion that the company should have been more careful about their choices and decisions. Some dreams are sugar-coated. They should have concentrated more on the reliability of the deals, and not just on the reliability of their website as well as the effectiveness of their marketing schemes. Again, that is just my OWN opinion.

    Now, why is now the office closed? The answer is basic. Some customers will destroy property, take things by force, threaten, hurt and even KILL people just for the sake of THEIR PRECIOUS MONEY. That is how EVIL money is. It can transform "professional" people into monsters. Who would want to face that kind of rage from those kind of customers? If it appears that Cleverbuy is running away, I cannot blame you and I understand your rage. Again, I cannot speak for the company or owner of Cleverbuy itself, but I believe that Cleverbuy will do its best to refund money, if not time and any other precious things wasted, to all its customers. But remember, there's also a thing called experience and of course, lesson.

    As far as I recall, Mr. Edgardo Garcia was not the one responsible for Cleverbuy. I'm just not sure if he has been automatically appointed this role when the company decided to concentrate on Cleverbuy alone. In fairness to him, he always questioned the budget for Cleverbuy as the company really invested on this business. They spent money just to ensure that the deals would really be 90% off. If the normal price is 10K, Cleverbuy will pay at least 3k just so its customers will pay only 4k. In other words, the company lost more money on marketing alone than it gained from its deals. There were also real problems with the bookings and Cleverbuy was not lying about that. I feel sorry for the disappointed customers but really, that was what happened. Nobody wants this to happen. I just believe that Cleverbuy is not running away. They are just having a hard time right now. I hope they will be able to return your money as soon as possible.

    1. Thanks for posting. I know that Cleverbuy started on good terms, I was able to redeem a voucher I bought from them before. I also liked their marketing efforts (the games etc) and customer service. They were one of the best group buying sites around, which was why I had my biggest purchase with them.

      The thing is, Cleverbuy handled the crisis terribly. It wouldn't have escalated like this if they were proactive in informing and refunding the clients. Remember, they have a list of sold vouchers and the buyers' contact info. It was easy to inform everyone of what happened and to give each buyer a schedule to pick up his refund. Instead, the buyers had to go through a lot of trouble and frustration and had to hear the bad news from other panicking individuals. The Cleverbuy management was not apologetic in any way and just hid and left their employees to suffer the wrath of the clients. If their concern was security, they could have employed some policemen or guards while continuing to handle the transactions. Instead, they completely stopped responding to inquiries and closed the office. Those moves changed the buyers' thinking from "Is Cleverbuy a scam?" to outright "Cleverbuy IS a scam."

      It's good that Mr. Edgardo Garcia attended the hearing last Friday. I hope he'll continue to show up until this case has been settled. I doubt the complainants will stop until they've received their money back or someone from Cleverbuy is behind bars.

      There is nothing to hide on the part of Cleverbuy. It will be more beneficial to them if they will be heard than be harassed by violent customers. They have no reason not to show up during hearing. Nothing to hide, only a lot to explain. No one in Cleverbuy is hiding from their obligation of paying the customers. They are hiding from violent customers and the risk of being exposed and accused by media without even being legally heard.

      If what you’re bragging about is that all these are just for money, then why those Cleverbuy CEOs didn’t just pay for those un-refunded vouchers, if their intentions and conscience are good, they need to face those customers who have trusted them, they should pay that hard-earned money of those small individuals (like me, who could only afford petty travel cost) or at the very least, if they are unable to produce such cumulative amount immediately, have the courage to ask for a reasonable amount of time and don’t just leave them hanging and waiting for nothing. If I am one of those CEOs, I’ll just return their money (which I think you still got an ample amount of your PRECIOUS money with you) even if I got broke ‘coz at least at the end of the day, I can still face every individual who have accused me and know very well that I have done what is best and righteous. Though I have already refunded my money, my sympathy goes to those small individuals of this country rather than those BIG TIME businessmen who value their PRECIOUS money than anything else.

      Family - We are a big family and very close family everyday we always talk to our cousins and aunts thru facebook but after this cleverbuy incident we dont talk that much anymore because we felt bad and responsible that we lost the money for our grand family reunion. Our relatives from europe even went home just to for this so can you just imagine the disapointment when they found out that they were scamed!


      My jobless cousin - He look for all kinds job just to save up for this.

      My working cousin - They also save up for this and It was a very hard year for them and the nature of their job is really difficut they have to work 6-7 days a week up 10pm without overtime or extra pay so they are really looking forward to have a vacation and spend some time with their only daughter that they barely see.

      My aunty - shes having a difficult time lately she lost millions of money due to a scam and shes having trouble with her family because of that.

      My cousin who purchase the voucher - She used to be active in facebook but now she wont even open her account because she feel embarrased and responsible that we lost our money even thour its not her fault. Her husband recently had a stroke and she have a pile of medical bills to pay.

      Me - Im a house wife and I recently had a baby I just want to take my daughter to a beach I want her to love the beach as much as I do so Im starting her early. This morning my husband and I had an arguement about Cleverbuy.

      Its very difficult for us to accept that we were scamed specially for ME DEFENDED CLEVERBUY to my family that they are a legitimate company and will not run with our money. I feel so humiliated by this.

  34. I agree with that Mr/Ms anonymous. I was just very upset of what happened. I'm a Marketing student that's why I know some things in the business especially what Clever does. Right now what I'm waiting for is their Official Statement to be released in public. Once and for all para kahit paano ma lessen yung anger ng bawat isa. Right now, awang awa lang talaga ako sa gf ko because of that hard-earned money. One year na siya sa work and she really have to render her leave she was very excited of having a vacation to relax and pamper herself but too sad this is what happened. I am very sorry for her. And the worse is I'm an online seller since 2009. I sell gadgets from cellphones to tablets and etc and dito lang pala ako madadali :)

      As for the official statement, I think Cleverbuy posted one before on their blog. The blog is now deleted. They should have kept that darn blog up and posted updates there to soothe the worries of their buyers and merchants.

    1. here's another side of this very unfortunate event.i am the owner of a slimming/skin clinic in the south and one of the merchants featured in cleverbuy.we are new in the business,we just opened last oct.2011. cleverbuy offered our deals starting december until it closed last may 30. we gained a lot of new clients and rendered excellent service to all these voucher holders. although cleverbuy has always been delayed in remitting their payments for the redeemed vouchers, they managed to update their payments till the month of april. but when the month of may came, they stopped remitting any payment for all our redeemed vouchers. 70% of our sales came from vouchers redeemed and this has not been paid to date and counting. due to our loyalty to our clients, we are still honoring their vouchers despite what is happening to cleverbuy. i don't know how to say no to all these clients who paid for these vouchers from their hard earned money. if any of you were in my shoes,and a merchant, how will you say no to all these voucher holders? how can we demand payment from cleverbuy?

To Mr. Edgardo Garcia, I know you and I hope God will guide you through these difficult times.   44. Magandang gabi po sa lahat. Isa rin po kaming biktima nitong cleverbuy pero ang pagkakaiba po sa lahat ng nagrereklamo dito sa site ay kami po ay isang hotel partner dito sa puerto galera. Mahigit 200,000 po ang hindi pa sa amin nababayaran ng cleverbuy at kanina lamang po namin nalaman na ganito pala ang nangyayari sa kumpanyang ito. Sa katotohanan po ay tumanggap pa po kami ng mga guests na may voucher mula sa kanila nitong nakaraang sabado't linggo at talagang nakapanlulumo ang balitang ito. Ngayon po ay nag-iisp po akong lumuwas upang pumunta sa kanilang opisina at makipag-usap ngunit mukha pong malabo yun dahil ayon nga po sa balita ay sarado na ang kanilang opisina. Ako po ay humihingi ngayon ng opinyon sa kung ano po ang mga hakbang na maaari po naming gawin tungkol po sa isyung ito. Maraming salamat po.

    i sincerely hope that mr. garcia still attends the meeting on june 8. he’s our only link to cleverbuy to date. and to be honest, medyo natakot ako na hindi na siya sumipot with all the media attention he’s getting. driver’s license (visible home address pa niya) at TIN card niya yun pinapakita sa news. i’m not losing hope na he’s a man of his word though.

    kung dumating po siya sa june 8 (2pm, Anti-fraud Division, 5th floor, NBI, Taft Avenue, Manila) , reminder po ulit to those who’ll be able to make it – please do your very best to stay calm. walang mangyayari po kung idadaan sa init ng ulo. magsasayangan lang po tayo ng oras ng isa’t isa kung hahayaan po natin na madala po tayo ng emosyon.

  48. Hi! Good Morning! i went sa office ng J2 last May 21, Hoping na makapagbook kami sa Boracay trip namin. Pero sarado na ung office nila and they refer their client to Cleverbuy so I went their para malaman kung ano na mangyayari sa voucher namin. Madami ng tao dun its like we are around 12 persons dun. Its a good thing na medyo mataray ung mga kasabay ko so they demanded refund. Ok naman ung pagharap nila sa amin especially the one incharge sa mga travel packages nila na si "Tommy". Initially medyo inconsistent na ung mga sagot nung ibang empleyado. Pero "Tommy" was accomodating and was able to explain the whole situation. sabi nila they can process daw the 3-4 weeks. But since mataray nga ung mga kasabay ko. They demanded a Post dated check to be issued that day. So we got our Post dated check. June 5 is the date. So tomorrow. Ipapaencash ko na siya. Sana maencash ko nga. Its P48,300 in total. I'll let you know kung naencash ko sya.

    3. UNFORTUNATELY GUYS THE ACCOUNT IS ALREADY CLOSED. When i went there the bank manager Ms. Carmina Maninbo said that may problema na ung account so they can't incash the check. I said if that is the case pls. stamp my check what's the reason why its closed. pero sa halip they advised me na ideposit sa saving account para daw dumaan sa clearing house. but i said nandito na ako, why do i need that. to think na client nio ung establishment. And sabi nila check nila kung magagawan nila ng paraan. pinapunta ulit nila ako sa lobby, after 10 minutes tinawag ulit nila ako para sabihin lang na close na ung account they tried to contact the account holder pero wala daw reply. and sabi nila "bank have the right to close an account if it mishandled" so if im correct it means na sila yung nagdecide na iclose ung account. I asked kung meron na ibang pumunta dun to incash checks, they said now lang ulit. Usually it was deposited sa mga personal accounts nung buyer and it was returned. sabi din nila that the accoount of cleverbuy was still in good standing last 2 weeks. I was like lamenting there about my story for the purchase. Hello di naman 10k lang yung voucher namin its 48300. In fairness to the Manager mararamdaman mo talaga na naawa siya sa akin kasi nung umiiyak na ko pati siya is naiiyak pero naiinis ako dun sa isang guy coz his like reasoning na " ma'am pasensya na kau we cant divulge any information kasi there is this law maybe you know about it the bank secrecy law." WTF??? I really dont know what and where to start. Nanghihinayang talaga ako dun sa pera.

  55. i really feel sorry to all who lost their hard-earned money. i also have 2 unused vouchers pero its just amounting to around P500 so lucky na pala ako sa lagay na 'to. thank God i thought twice of buying the travel deal to Coron last month kasi i read a comment from someone na ilang times narebook yung flight nila kasi lagi silang offloaded ng airline pero nairefund naman sa kanila yung money after some time. but looking at the situation now, refund is quite unlikely. the only consolation we can get at this point is to (hopefully) file a formal case against the management of cleverbuy & for bad karma to come haunt them (if they indeed deliberately duped innocent/trusting people like us)...

    Thank you for the very informative updates about Cleverbuy. We also bought a travel deal from them last December 2011 and had the same not good experiences with their service so we opted to get a refund last mid-May. They told us to get the cheque on June 12 but upon hearing that they are "temporarily" closed and hearings are on going, we too got very disappointed. I'm sure none of us wants to go through all the hassle of getting affidavit, demand letter and attending the hearings. We just want a refund. Plain and simple. Get our hard earned money then that's it. I just hope Cleverbuy would just settle the accountabilities to their buyers so one of us would have the all the stress and hassle. Now, we're thinking if we would also file a complaint since we also have day jobs and don't have the time to attend the hearings. Please keep us updated through your blog. We do really hope to see some light in this case and everything will be settled. Thank you very much.

We have already filed complaints in DTI but we were advised na idiretso na lang sa NBI since this looks like a criminal case.   58. Guys, Sino sa inyo ang recently lang bumili ng vouchers using credit card? May nag advise po sa akin, call Mozcom or yung credit card hotline nyo to inform about the Cleverbuy scheme. baka pu-pwede nyo pa maihabol ang money nyo. Pwede kasing hindi pa nagbabayad si Mozcom kay Cleverbuy, at least you have a chance to get your money back.

Sabi lang sa amin nung attorney sa DTI, we will be asked for a narration ( details ng complaints) then have it notarized. Mas OK kasi na mas marami ung magfi-file para ung chrages against Cleverbuy ay mas bumigat sa permisyong dinulot nila sa customers nila.

  60. i just tried to encash the check dated today in chinabank, unfortunately CLOSE NA ANG ACCOUNT NG CLEVERBUY!!! i was advise to deposit the check to other bank and get a documentation that it was close so i can use it in filing a case. According to chinabank kahapon lang naclose ang account ng CLEVERBUY. I would like get some help how to use this against CLEVERBUY!!! Sobrang dami na nilang perwisyong ginawa!!!

  64. Ako rin I still have unused vouchers sa Mary Pauline Salon. expiration nung voucher ay sa November pa naman. It cost 1500 for rebond color, and keratin treatment. I called the Mary Pauline Salon and they said naka-hold din ang cleverbuy vouchers. Ang offer na lang nila sa akin ay avail ko ung 1499 na discount price nila ngayon for rebond. sO meaning I have to pay another 1499. They said hindi namn daw ako lugi kc originally eh 7k plus ung package na un../ hays what should I do?

  74. The news rattled me when I saw it last night. May unclaimed vouchers pa kami. My sis-in-law na nsa UAE eh parating na end of month tapos sa palawan ang punta so when we heard the news tumawag kami sa agency which is fully richman. ayaw na nila e honor ang travel although booked na sya. hindi pa daw kasi sila nababayaran ng cleverbuy at mag kakaso din sila kasi may mga local and intl travels pa sila na hindi pa nababayaran. nung una sabi nila kahit daw plane tix e cover nila pero after 10mins tumawag sabi hindi na daw kasi they were not paid. I don't know kung totoo kasi mejo matagal na rin na book to. how do we go about with the complaint? can we do it in behalf of my sis-in-law since wala sya sa country sa duration ng hearing etc. kasi sakanya nakapangalan ung ibang vouchers. thanks sa blog na to. really helps.

Hi Mrs. Ong, pagawa kayo sa lawyer ng SPA na notarized na pinapayagan kayo ng sis-in-law na kayo mag aasikaso nung case nya to file against cleverbuy and the travel agency. unang una, dapat di kayo pumayag ng ganun kasi, whether binayaran ng cleverbuy or hindi yan travel agency dapat sagot nila yang voucher na binayaran nyo. diba. kasi issue ng merchant un from cleverbuy, bakit pati customers like us eh nadadamay sa kaguluhan nila. kaya kng mag ffile kayo ng complaint, isama nyo na yung travel agency/merchant na ayaw i-honor yung paid vouchers nyo.

Don't worry the agent was so scared when I told him na we are filing a case and i will quote what he told me na ihold nila as per management decision daw. na book nya na daw kasi without pa ng payment ng cleverbuy kasi maayos kaming kausap saka sabi ng cleverbuy na they will pay besides pinabook namin un before this brouhaha.but accdg to them since nga yata start ng year hindi na ok ang cleverbuy hindi rin nila nakita na mangyayari to. we'll see. i posted the contact numbers below this is from fullrichman agency.

While I think this merchant has an obligation to us, I still want to get more facts before I get into conclusions. I'm really upse t with the situation but I know I need to clear my mind. I suggest you start making your own formal complaint (full details from the time you bought your vouchers, the time/s you call or went to Marvin Plaza for follow up for your hotel and flight bookings, all documents that can be used as evidence) have it notarized and send it to NBI. MAS MAY HABOL PO KAYO FOR REFUND KUNG MAGFILE KAYO NG FORMAL COMPLAINT. Wala pong mangyayari if reklamo lang ng reklamo sa post/blogs. Para hindi masayang ang hard earned money nyo, at least kung magfi-file kayo sa NBI, alam nyong may habol kayo sa Cleverbuy.

  90. As confirmed by NBI, wala pong hearing on June 8. Possible na mediation lang yun pero walang hearing. All complains towards Cleverbuy, sa CCU ang handling. You can send your affidavit directly to NBI. Please do this ASAP so NBI can start their investigation. Mas maraming complaints mas maganda para mas grave ang charges against Cleverbuy

  93. Guys, need your opinion? Is there a similar case as ours, J2 already booked us a flight this June but they did not send us a service voucher for the accommodation and tour. According to the airline this booking can still be change 24 hours before the flight so we don't have an assurance that they will not cancel it. Were planning to use the flight just in case we can't refund our money at least our loss will be minimal but were afraid that the agency who booked this plane tickets will cancel it.

I heard that some dealmakers of Cleverbuy also were cheating with merchants and especially with triptoe together. is this true? who are the dealmakers? they are ripping of my hard-earned money together with merchants and cleverbuy. i will also file a case against them. can someone post the names and phone numbers?

  95. Sa mga nakapunta na sa NBI. Help naman.I called NBI's hotline kasi this evening and sabi nung nakausap ko, pwede magfile ng formal complaint sa office nila at sila na rin mismo ung gagawa ng afidavit at magpapanotarize nung mga papers. Is this true or kailangan notarized na ung mga vouchers,receipts and email conversation bago pumunta dun? Please help.

I am staying here in Laguna and though it will be a real hassle for me to go to NBI, I will try to file a complaint. Tsk.Buti nalang pala nakapag travel kami sa Coron last March.It was a hellish experience dealing with these people (Cleverbuy and J2 Travel)...Dec.23,2011 yung first day ng booking at sinadya naming pumunta dun para lang makapag book kagad, only to find out na holiday leave na sila lahat and babalik ng 1st week of January. So 1st day ng pagbalik nila ng January punta na naman kami. As usual puro pangako, bigay ng number, call back etc. Umabot hanggang Feb. tapos sinabi nila na wala ng travel dates available kasi fully booked na airline at resort. Aba nagpintig tenga ko, sabi ko e kung ganun e di sana di nyo nalang sinabi na yung travel period is January-June. June onwards nalang daw yung available na dates, kabwiset. Ano yung bagyo at maulan na! Kaya nga nagpa book kagad kasi dapat sa anniv namin yan. Sabi ko if di nyo kami mabo-book sa preferred dates namin, I demand a full refund -- wala akong ibang travel dates na pwede beyond March 1st week kasi lipat nako ng US..babayaran nyo ba yun? ayun buti inasikaso dahil araw araw akong tumatawag on their unreachable numbers. Ang palusot pa is they've been trying to reach us DAW kasi ready na tickets and booking. Yung booking sa resort na confirm lang 2 weeks before nung flight. Nagbayad pa kami ng extra for the "airline upgrade" which we didn't mind nalang din since morning flight and late afternoon yung return flight tapos CebPac pa. I also had to constantly keep in touch with the resort to confirm na may susundo at may booking kami. Once we got there, we swore never to deal with Cleverbuy again and J2 Travel. Unahan lang talaga ng takot kaya inayos yung trip namin. Buti nalang enjoy yung trip at maganda yung resort. Hayys.

  101. to hazelanne, tumawag ako kahapon sa bank. sabi lang nila, approved na daw kase yung transaction so sa merchant na talaga ako dapat makipag communicate regarding sa reversal. nung may 23 lang transaction ko. habulin ko sana kase ngayong june palang siya papasok sa bill ko. hays.
